Please be advised that by requesting service you, as an owner of your unit and member of the association are agreeing to the following payment terms:

1. CHARGED TO OWNER ‐ If the service provided is to correct an issue or repair an item that (per the governing documents), is found NOT
to be the responsibility of the association; the cost of repairs will be charged back to the owner by the association.
** If you are not the owner of the unit you must contact your landlord or landlord’s management company to request service
2. INSURANCE CLAIMS – If you request an insurance claim be filled, keep in mind the deductible is $10,000.00 and you are most likely going to be the responsible party.

Leak Investigation & Cost Responsibility Policy

1. Purpose

Clarify the responsibilities of unit owners and the HOA when investigating and addressing leaks that impact condominium units.

2. Leak Investigation Process

  1. Owner Reporting – If an owner notices a leak, they must submit a written service request through the HOA’s designated portal or management office.
  2. Initial Assessment – The HOA will assess whether the leak potentially involves common elements (e.g., roof, exterior walls, shared plumbing lines).
  3. Vendor Inspection – If required, the HOA will engage a vendor to investigate the source of the leak. The cost of the investigation will be allocated based on the findings (see Section 3).

3. Responsibility for Costs

  1. If the leak is determined to be caused by an HOA-maintained element (e.g., common plumbing lines, exterior damage):
    • The HOA will cover the cost of the investigation and necessary repairs.
  2. If the leak is determined to be caused by an owner-maintained element (e.g., unit-specific plumbing, appliances, windows, personal fixtures):
    • The responsible unit owner must reimburse the HOA for the investigation cost and is responsible for repairs within their unit.
  3. If the leak originates from another owner’s unit and causes damage to a neighboring unit:
    • The responsible unit owner (where the leak originated) must reimburse the HOA (if applicable) or the affected unit owner for the cost of the investigation and is responsible for repairs.
    • The affected unit owner may need to file an insurance claim with their personal insurance provider if damage occurs within their unit.
    • The HOA may assist in notifying the responsible unit owner but will not mediate disputes between owners.
  4. If the investigation determines that the leak is not the responsibility of the HOA but the requesting unit owner:
    • The requesting unit owner must pay the investigation fee and is responsible for further necessary repairs.

4. Dispute Resolution

If an owner disputes responsibility for a leak, they must submit a written appeal to the HOA board within 10 business days of receiving the invoice/determination. The HOA board will review the documentation and may request additional expert opinions.

5. Insurance Considerations

Owners are strongly encouraged to maintain adequate homeowners’ insurance (HO-6 policy) to cover water damage to their unit and personal property. The HOA’s insurance typically covers common elements only and does not extend to damage within individual units.

6. Enforcement

Failure to reimburse the HOA for investigation costs or complete necessary repairs within the required timeframe may result in a violation notice, fines, or other enforcement actions as permitted by the HOA’s governing documents. This may include legal action or the placement of a lien against the responsible owner’s unit, if applicable.
